Members present:
Chair Neal Carpenter, NC; Joe Strauch, JS; Tim Flanagan, TF; Vince Ammendola, VA; David Lane, DL; Rose Fitzgerald Casey, RFC; Dick Ferren, DF

Lenox Gateway, LLC, 55 Pittsfield Rd., Map 17 Parcel 40, DEP 198- 0217, one year extension on Order of Conditions, SK Design.

Jim Scalise of SK Design and Matt Ward of LB Builders were present.  

Mr. Scalise explained that there is a pending transfer of ownership of the northern portion of the property which includes the residential component.  To acquire financing, the new developer needs a minimum of a one year extension on the Order of Conditions.   

Mr. Ward offered to the Commission his company’s expertise and its intention to complete the work that had been agreed to previously by David Case.  If they are unable to secure financing they cannot proceed.  

DF made a motion to grant a one year extension and JS seconded the motion.  The Commission voted to extend the Order of Conditions 6-1, with TF casting the dissenting vote.  

Shakespeare and Company, 70 Kemble St., Map 7 Parcel 22, DEP 198-0226, three year extension of Order of Conditions, Rob Hoogs, Foresight Land Services.  

In a subsequent conversation with Mr. Hoogs, NC said that a one year extension would suffice.  RFC made the motion to extend the Order of Conditions for one year and DL seconded the motion.  The Commission voted to agree 7-0.

Craig Kirby 76 Dunmore Court, 8-6-48DEP 198-200, Certificate of Compliance.

NC went to the site on September 15, 2009 and determined that all of the work had be completed.  VA made a motion to issue the Certificate of Compliance and DL seconded the motion.  The Commission voted to agree 7-0.

Minutes of September 3, 2009-JS made a motion to approve the minutes and TF seconded the motion.  The Commission voted to approve 7-0.

RFC made a motion to adjourn and JS seconded the motion.  The Commission voted to agree 7-0.
